For as long as people have been less than honest with each other, false advertising has existed. Luckily, however, California laws prohibiting this practice with regard to consumer goods and services are perhaps the strongest in the nation, yielding extraordinary amounts of damages, including punitive damages, for the benefit of unsuspecting purchasers. The area of consumer fraud is wide reaching, including claims for misrepresentation, “bait and switches,” price fixing, “tying” practices and unfair competition. Without a law firm skilled in handling such cases, as we have done many times, the laws around consumer fraud can seem complex and confusing.
